CBD isn't banned as a food ingredient, but CBD extracts are classed as novel foods and need authorisation. In England and Wales, the FSA currently allows certain existing CBD products linked to qualifying applications to remain on the Public List while their applications are considered. Being on the Public List does not mean a product is authorised or FSA-approved, and local authorities remain responsible for enforcement.

A novel food is one that was not widely eaten in the UK before May 1997. CBD food products fall into this category, so they need an independent safety assessment and authorisation before they can be sold without restriction.
